Terms and Conditions

These Terms of Use govern the terms of service you are bound by as a customer of Pawsome Friends DMCC. Pawsome Friends DMCC may, subject to the provisions of this paragraph, amend the Terms of Use at its sole discretion at any time. The most recent version of the Terms of Use will be available on Pawsome Friends DMCC’s website. As a Customer, you unequivocally agree that you shall be responsible for periodically checking the website for updated Terms of Use (which shall be dated), and further agree to be bound by any such amendments to the Agreement upon such notification.

 

Definitions

Customer: refers to a customer of Pawsome Friends DMCC in the ordinary course of business.

 

Customer Data: means all identifiable information about customers generated or collected by Pawsome Friends DMCC including, but not limited to, name, date of birth, email addresses, phone numbers, preferences and tendencies, and financial transaction data.

 

Customer Service: means the service provided to the customer according to the type of service the customer has asked for, such as pet boarding, grooming, or pet trading.

 

Marketing Purpose: refers to the marketing strategy which Pawsome Friends DMCC may from time to time implement for the purpose of promoting it’s services.

 

Pet Boarding: a lodging service provided by Pawsome Friends DMCC, which allows customers’ pets to remain at the Premises for an extended stay or overnight.

 

Pet Grooming: refers to the grooming service provided by Pawsome Friends DMCC, which includes the hygienic care and cleaning of pet dogs, enhancing physical appearance.  

 

Premises: refers to the Pawsome Friends DMCC unit located at Swiss Tower, shop 101/102, Cluster Y, Jumeirah Lake Towers, Dubai, United Arab Emirates.

 

Principal: refers to Pawsome Friends DMCC, its subsidiaries, agents, employees, directors, and any applicable assignee who its rights are transferred to.

 

Point of Sale: means at the point where a customer is asked to pay for the service and/or product, and includes electronic payment or cash payment, whether online or in person.

 

  1. Services

    1. Pawsome Friends DMCC will offer two primary services:- pet boarding and pet grooming.

    2. Pawsome Friends DMCC may review any such loyalty programme from time to time to ensure it adequately rewards its customer base.

    3. The customer is responsible for providing accurate information relating to the service offering and its rewards programme.  The customer assumes all liability for any inaccuracies or misstatements made or provided to Pawsome Friends DMCC.  

    4. Pawsome Friends DMCC reserves the continuing right to reject, revise, or discontinue any customer offering, loyalty or rewards scheme at any time and for any reason in Pawsome Friends DMCC’s sole discretion, and to terminate the service and to remove all references to the loyalty or rewards scheme from the Website.

    5. Pawsome Friends DMCC has sole discretion to refuse its service offering to any customer.
       

  2. Payment

    1. All payments from the Customer to Pawsome Friends DMCC shall be made in United Arab Emirates Dirhams (AED) at the point of sale.

    2. Payments are Vat taxable.

    3. The price list will be subject to review and may be adjusted according to market rates. Pawsome Friends DMCC shall keep the price list up to date.
       

  3. Customer reviews and recommendations

    1. Pawsome Friends DMCC is not responsible for the reviews and comments left by customers about Pawsome Friends DMCC with regards to the customers’ feedback.

    2. Customers must not provide fake or wilfully malicious statements about the service.

    3. Pawsome Friends DMCC has no influence over the reviews left for any particular Customer or the order in which it is seen by customers and users of Pawsome Friends DMCC.
       

  4. Marketing

    1. Pawsome Friends DMCC and its business partners may communicate with the customer with regard to products, promotions, and other services that may be of interest. This may include email or other communications. Pawsome Friends DMCC may also solicit the customer’s opinion for market research and improvement purposes.

    2. The customer warrants to cooperate with Pawsome Friends DMCC and shall not unreasonably withhold information or consent related to the Marketing Purpose.
       

  5. Waiver

    1. By engaging the services of Pawsome Friends DMCC, the customer shall be asked to sign a waiver which confirms the customer shall waive any and all claims against Pawsome Friends DMCC, its employees, agents, contractors or affiliates for any loss, damage, injury, illness, theft, death, or other such losses associated with the customer’s pet, whilst in the care of Pawsome Friends DMCC.
       

  6. Indemnification

    1. In the event of the customer’s pet causing loss, damage, injury, illness, death or other associated losses to Pawsome Friends DMCC, or to any employee, agent, contractor or affiliates, to any other pet under the care of Pawsome Friends DMCC, the customer will be held responsible for the actions of their pet and indemnify Pawsome Friends DMCC in full for such consequential loss. 
       

  7. Limitation of Liability
    Pawsome Friends DMCC are required to have insurance in place. The limit of indemnity is [XXX] AED.

     

  8. Dispute Resolution

    1. This agreement, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with the laws of the United Arab Emirates.

    2. Each party irrevocably agrees that the Disputes Centre administered by the Dubai Multi Commodities Centre (DMCC) shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims) by way of mediation.

    3. Failing amicable resolution by mediation, either party may choose to bring court proceedings against the other party. In the event of such a dispute, difference, controversy or claim arising out of or in connection with this contract, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge and applicable remedies, shall be subject to the exclusive jurisdiction of the Courts of the Dubai International Financial Centre (“the DIFC Courts”).
       

  9. Other

    1. This is subject to the laws of the United Arab Emirates.

    2. The customer is not authorised to transfer or assign its rights or obligations under this Agreement. Pawsome Friends DMCC is authorised to transfer or assign this Agreement to a present or future affiliate or pursuant to a merger, consolidation, reorganisation or sale of all or substantially all of the assets or business, or by operation of law, without notice to the customer.

    3. If any provision of this Agreement should be held to be invalid or unenforceable, the validity and enforceability of the remaining provisions of this Agreement are not affected.
